PUBLIC OFFER AGREEMENT FOR PAID JUGGLING ONLINE EDUCATION COURSE
(In accordance with German law and the legislation of the European Union)
1. General Provisions
This document constitutes a public offer agreement (hereinafter referred to as the “Agreement”) for the provision of paid online educational services in juggling. The Agreement is entered into between Kateryna Nikiforova, acting as an independent service provider (hereinafter referred to as the “Provider”) and any individual accepting this offer (hereinafter referred to as the “Client”). By accepting the terms of this Agreement, the Client enters into a legally binding contract with the Provider under the terms outlined below, in compliance with German law and the applicable regulations of the European Union.
2. Subject of the Agreement
The Provider offers access to an online juggling course at course.juggling.pro that includes instructional videos, exercises, and other digital materials designed to teach juggling at various skill levels. The Client agrees to pay for access to these materials in accordance with the terms of this Agreement.
3. Acceptance of Terms
The terms of this Agreement are deemed accepted by the Client upon the completion of payment for access to the online juggling course at course.juggling.pro. Payment serves as confirmation of the Client’s agreement to the terms of this Agreement.
4. Fees and Payment
4.1. The cost of the online juggling course is specified on the Provider’s website juggling.pro.
4.2. Payment must be made in advance by the Client using one of the payment methods indicated by the Provider. The Client will gain access to the course materials course.juggling.pro within 24 hours of the Provider’s receipt of payment.
4.3. The Provider reserves the right to adjust course prices at their discretion. Any changes will not affect the prices applicable at the time of purchase for current clients.
5. Client’s Rights and Obligations
5.1. The Client has the right to access the online juggling course materials at course.juggling.pro after payment.
5.2. The Client undertakes not to distribute, share, upload, or resell the educational materials provided by the Provider without prior written consent.
5.3. The Client agrees to adhere to the Provider’s recommendations for the proper use of the course materials.
6. Provider’s Rights and Obligations
6.1. The Provider shall grant access to the online course materials as advertised and provide support in case of access issues.
6.2. The Provider reserves the right to update or modify course content as necessary to improve course quality or correct errors.
6.3. The Provider reserves the right to revoke course access for Clients who violate the terms of this Agreement without any refund.
7. Refund Policy
7.1. Customers may request a refund within three (3) days of purchase, provided they have neither copied nor downloaded any course materials.
7.2. No refunds shall be granted at any time if the Client has downloaded or copied any educational materials, including videos available on the course.juggling.pro platform.
7.3. All refund requests must be submitted in writing to ketrinniki.edu@gmail.com. Refunds will be processed within fourteen (14) days of the request’s approval, in compliance with applicable consumer protection laws in the European Union.
8. Liability
The Provider’s liability for any damages arising from the use of the course materials is limited to the amount paid by the Client. The Provider is not responsible for specific results achieved through the course or the application of skills learned. The Provider also disclaims liability for any injuries or damages caused by performing the tricks demonstrated in the course materials.
9. Data Protection
The Provider is committed to protecting the Client’s data in accordance with the General Data Protection Regulation (GDPR) and relevant German data protection laws. The Client consents to the processing of their personal data solely for the purpose of providing educational services.
10. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the Federal Republic of Germany and the applicable regulations of the European Union. Any disputes arising under this Agreement shall be resolved by the competent courts in [insert applicable jurisdiction, typically the Provider’s location].
11. Final Provisions
11.1. By purchasing the course, the Client confirms their agreement with the terms of this Agreement.
11.2. The Provider reserves the right to amend the terms of this Agreement. Any changes will apply only to future purchases unless otherwise mutually agreed.
12. Use of Client Videos for Promotional Purposes
12.1. The Client may opt to share videos of their learning progress with the Provider for feedback or other purposes. By submitting such videos, the Client grants the Provider a non-exclusive, worldwide, royalty-free right to use, edit, and publish the videos for promoting and advertising the online juggling course.
12.2. This permission includes using the videos on the Provider’s website, social media platforms, and other marketing materials related to the course.
12.3. The Provider will respect the Client’s privacy and will not disclose personal information (e.g., names) without the Client’s explicit consent.
12.4. The Client retains the right to withdraw this permission at any time by notifying the Provider in writing. In such cases, the Provider will cease using the Client’s videos in future promotional materials.
